RESUMO: O presente artigo tem por escopo selecionar aspectos gerais do tema “improbidade administrativa” com um aprofundamento no ponto “elemento subjetivo”, discorrendo sobre a responsabilização por improbidade administrativa nas modalidades “culpa” e “dolo” à luz da interpretação atual da Lei 8.429/1992 e da Constituição Federal. O que se pretende é a investigação a respeito de como o tema vem sendo tratado pela doutrina, de modo a demonstrar como e em que ocasiões se dá a responsabilização por improbidade administrativa. A partir da pergunta: “em que medidas o elemento subjetivo influencia na responsabilização por improbidade administrativa?”, o presente trabalho proporciona um esclarecimento de questões atuais na responsabilização por improbidade.

ABSTRACT: The purpose of this article is to select general aspects of the theme “administrative improbity” with a deep examination of the point “subjective element”, discussing the responsibility for administrative improbity in the “fault” and “malice” modalities, according to the Law 8.429/1992 and the Federal Constitution. What is intended is the investigation of how the topic has been treated by the doctrine, in order to demonstrate how and on what occasions the responsibility for administrative improbity occurs. From the question: “to what extent does the subjective element influence accountability for administrative improbity?”, the current work provides an explanation of issues in accountability for administrative improbity.
