A FIARC COMO (DES) INCENTIVO À JUDICIALIZAÇÃO DO ABUSO DE PODER REGULATÓRIO ESTATAL

Resumo: Objetiva analisar a Frente Intensiva de Análise Regulatória e Concorrencial (FIARC) na perspectiva de seus objetivos administrativos e possíveis efeitos perante o Judiciário. Como política pública propriamente dita nascida para coibir o abuso regulatório dentro da Administração Pública, o artigo também perpassará, necessariamente, pelo deslinde da controvérsia acerca dos limites da intervenção judicial na orbita administrativa. Será feita uma análise das competências atribuídas ao órgão de defesa da concorrência e ao Judiciário, quando tratada da matéria aquele atinente. Igualmente, o trabalho em tela abordará a questão da segurança jurídica e eficácia trazidas pela Lei 13.655/2018 combinada com os diplomas normativos que tratam dos assuntos supramencionados.

FIARC AS (DIS) INCENTIVE TO THE JUDICIALIZATION OF THE ABUSE OF STATE REGULATORY POWER

Abstract: It aims to analyse the Intensive Regulatory Analysis Front (FIARC) from the perspective of its administrative objectives and possible effects before the Judiciary. As a public policy properly born to curb regulatory abuse within the Public Administration, the article will also, necessarily, run through the controversy about the limits of judicial intervention in the administrative orbit. An analysis of the competences attributed to the competition defense body and to the judiciary will be made when the relevant matter is dealt with. Likewise, the work on screen will adress the issue of legal certainty and effectiveness brought by Law 13.655/2018 combined with the normative diplomas that deal with the aforementioned issues.
