AS CONTROVÉRSIAS DOUTRINÁRIAS QUANTO À NATUREZA DA CFEM, A DECISÃO PROFERIDA PELO STF E RESPECTIVOS REFLEXOS NA GESTÃO DOS RECURSOS

Resumo: O presente trabalho pretende contribuir para o estudo sobre um instituto do Direito Minerário, qual seja, a compensação financeira sobre a exploração de recursos minerais – CFEM, ligeiros apontamentos sobre o referido instituto, a importância da definição no que tange à sua natureza jurídica, especialmente para seus fins de arrecadação e fiscalização, bem como e, precipuamente, a busca por auxiliar na gestão de seus recursos de maneira íntegra e coerente com o(s) objetivo(s) pelo(s) qual(is) motivou sua implementação no ordenamento jurídico pátrio. Para tanto foi analisada doutrina sobre a matéria, principalmente relativas às divergências existentes sobre as diversas questões acerca da referida compensação.

THE DOCTRINAL CONTROVERSIES REGARDING THE NATURE OF THE CFEM, THE DECISION PRONOUNCED BY THE STF AND ITS REFLEXES IN THE MANAGEMENT OF THE RESOURCES

Abstract: This paper aims to contribute to the study of an institute of Mining Law, namely, the financial compensation for the exploitation of mineral resources - CFEM, light notes about the institute, the importance of defining the terms of their legal nature, especially to their collection and inspection purposes, as well as and, primarily, the search for help in managing their resources fully and consistently with the (s) objective (s) by (s) which (is) led to its implementation in order legal parental rights. For this was analyzed doctrine on the matter, especially regarding existing differences on the various issues concerning the compensation payments.
